Make it Simpler to Sell to the US

US Sales Tax is one of the most complicated tax systems that an ecommerce brand will have to engage with. Each of the fifty states (and Washington D.C) decides:
  • What their sales tax rates are
  • At which point you need to register (sales tax nexus)
  • Which products are taxable (and at which rate)
  • How often you have to file a sales tax return
Some states don’t even have a state-wide sales tax, but individual districts within those states do.

Sales Tax Nexus

You’ll need to register for US sales tax when you’ve reached sales tax nexus.
There are two kinds: Physical nexus and Economic nexus.
Physical nexus
Generally speaking, you reach physical nexus when you have a tangible presence in the state. That could be owning a distribution centre or having employees there. The most common reason ecommerce sellers reach physical nexus is holding stock in a state.
Economic nexus
Economic nexus is a threshold in either revenue or transaction volume that each state sets. Typically, you’ll need to register one you hit either $100,000 in sales or 200 transactions in a single calendar year.
Every state is different and reaching sales tax nexus isn’t the only reason you might need to register. We’re here to make it simpler to know if you’ve reached nexus or are about to. In most US states, Amazon is recognised as a Marketplace Facilitator. That means they’re responsible for handling the sales tax for you. However, some still require you to register, even if Amazon is your only sales channel.

The processing time for a sales tax application varies by state. If there aren't any delays, it usually takes approximately 4-6 weeks.
In most cases, you don’t need a US entity to register for sales tax. However, you’ll definitely need an Employer Identification Number (EIN), which AVASK US can assist with.
No, you don’t need to register until you’ve hit nexus, which varies by state. This also varies based on the platform that you sell on, for example, Amazon and other Marketplace Facilitator doesn’t require sellers to be registered in every state.
If you cross an economic nexus threshold in the middle of the year, you’ll need to register for sales tax in that state. Once you’re registered, you’ll need to start charging and remitting sales tax in that state.
